If you or someone you know has been involved in a drunk driving accident, it is important to know the different categories. It varies nationwide, but most states separate situations between standard DUIs and aggravated DUIs. Since these are not created equal, it is so important to know the difference.
Each type of charge will result in different consequences. Usually, first-time offenses are given fines, probation, counseling, or license suspension. However, if this is a repeated offense, an individual can face prison time.
Standard DUIs
If someone is caught driving under the influence, they will most likely be pulled over and tested. The testing method will examine their blood alcohol concentration level (BAC). If their BAC is at or above 0.08%, it is considered a DUI.
This can only be considered a misdemeanor DUI if there is no property damage or injured individuals. A standard DUI can cause substantial fines, court screenings, classes, and more. Further, if you are injured by a person driving under the influence, it is critical to get help, so they get the punishment they deserve.
Extreme DUIs
Some states put some of their DUI cases in the extreme category. In this situation, the driver’s BAC is at 0.15%. Which is almost twice the amount of the level that contributes to a standard DUI.
This type of DUI is still considered a misdemeanor but is followed with more serious consequences. There is mandatory jail time, higher fines, car breathalyzers, and revoked driving privileges.
Aggravated DUIs
While the first two types of DUIs rely on BAC levels, aggravated DUIs do not. In this situation, there are other factors that determine if someone has been involved in an aggravated DUI.
If the individual is a repeat offender, there were minors in the vehicle at the time of the accident, the property was damaged, people were harmed, or the driver does not have a valid license, it is automatically considered aggravated.
This is a felony and there are substantial consequences. A person can be fined heavily, must attend classes, get their driving privileges revoked, and prison time can be served.
