On July 22nd, the Phoenix Fire Department responded to an accident scene with multiple crashed cars and one engulfed in flames.
Police determined that a stolen car was traveling at a dangerous speed down 43rd Avenue before colliding with a vehicle that was attempting to make a left turn on Thunderbird. All of the passengers inside the vehicle that was it were pronounced dead at the scene.
One of the people that were killed was identified as Terry Hill, a Lyft driver. He was driving for the rideshare company at the time of the accident. The collision also killed his two passengers. Terry was on his last ride of the night.
Who is liable for the accident?
David Shapiro, an attorney in the Pheonix area, stated that rideshare accidents are increasing and they see them almost weekly.
Investigators have determined that the driver of the stolen vehicle is at fault for the accident. However, Shapiro has stated some complications surrounding this particular case. He explains that since the liable vehicle is stolen, there is most likely no applicable insurance.
In most cases, the injured driver can sue the person that was at fault in the accident. Since the rideshare driver was not at fault, the rideshare company might not be liable for injuries or death.
Shapiro states that individuals that use rideshare frequently should have uninsured motorist coverage on their policies to help with unexpected expenses that these companies will not cover.
